Nexen shareholders approve takeover by China's CNOOC

Nexen shareholders on Thursday overwhelmingly approved Chinese state-owned energy giant CNOOC's $15.1 billion takeover bid for the Canadian oil and gas company.

A new public opinion poll, however, shows Canadians strongly opposed to the deal, which has yet to be approved by regulators.

The proposed takeover would be China's largest foreign investment and its largest energy deal, according to data firm Dealogic.

"The arrangement was approved by approximately 99 percent of the votes cast by Nexen common shareholders and approximately 87 percent of the votes cast by Nexen preferred shareholders at the special meeting held on September 20, 2012," said a Nexen statement.

An Abacus Data poll conducted for the Sun newspaper group, however, found 69 percent of Canadians oppose the takeover. Only eight percent said they want to see Ottawa greenlight the deal.

"The gut reaction of the public is just simply 'no'," pollster David Coletto told Sun News.

About 15 percent of respondents cited China's poor human rights record in rejecting the deal, while others oppose it "on strategic grounds, that this is not a resource we should be giving up to foreign companies -- any foreign company," Coletto said.

The Abacus Data survey with a 2.9 percent margin of error was conducted online with 1,208 participants between September 14 and 18.

Oil prices mixed amid China demand worries, better US data
London (AFP) Sept 20, 2012 - Oil prices were mixed on Thursday after recent sharp falls as investors weighed prospects of weaker energy demand by China against slightly improving US jobs data.

Brent North Sea crude for delivery in November gained 76 cents to $108.95 a barrel in late London deals, a day after Brent futures closed down almost four dollars on talk that Saudi Arabia was boosting crude supplies.

New York's main contract, light sweet crude for October dipped 13 cents to $91.85 a barrel after shedding more than three dollars on Wednesday.

Official data published Thursday showed new claims for US unemployment insurance benefits fell slightly last week to stand at 382,000. The United States is the world's biggest consumer of oil.

Crude prices had meanwhile fallen by about a dollar in London and New York earlier in the day after data showed manufacturing activity in the world's largest energy consumer China contracting for the 11th straight month.

Analysts said recent price support won from the US Federal Reserve's decision last week to embark on a third round of exceptional stimulus measures, or quantitative easing (QE3), had tailed off.

"The extended losses are hinting more and more that the bullish impact of QE3 had already been priced into the market for several weeks (ahead of the announcement) and that the focus is now on weaker global economic growth indicators," JBC Energy research group said in a note to clients.

Crude demand worries were stoked after British banking giant HSBC released data showing China's manufacturing sector still stuck in a rut, said Justin Harper, a strategist at IG Markets Singapore trading group.

"The China data has pushed down commodities after HSBC's flash PMI showed contraction for another month," he told AFP.

"Oil has been on the receiving end of this negativity towards the Chinese economy and more evidence of its continued slowdown. China is a major consumer of oil and any slowdown in its economy worries traders about future demand."

The preliminary reading of the purchasing mangers' index (PMI) for China released by HSBC hit 47.8 this month, a mild improvement from a final reading of 47.6 in August, the bank said in a statement.

But the latest reading marked nearly a year of continuous contraction since November, underscoring broader economic weakness and shrinking demand in key overseas markets.

The index is closely watched as it gauges nationwide manufacturing activity, a key sector of the world's second-largest economy. A PMI reading above 50 indicates expansion, while anything below 50 points to contraction.

China's official PMI figure for August released earlier this month hit a nine-month low of 49.2.

Frankenweenie #DisneyMoviesEvent Day 1 & 2 - A Mom's Impression

I am having a blast here in LA. Last night we arrived and spent the evening with celebrities? wax one that is!? Madame Tussauds Wax Museum invited us to experience their Hollywood museum.? Some of them were so life like? it was a little weird to be honest.

After Madame Tussauds, we met at Hard Rock Cafe for a welcome dinner and a meet and greet time!? I sat with some bloggers that I had never met before and had a wonderful time! I love meeting new friends and putting faces with friends that I have chatted with online.

Today we will be interviewing cast members from Frankenweenie and then attending the premiere and after party.

Here is a little more about the movie:

From creative genius Tim Burton (?Alice in Wonderland,? The Nightmare Before Christmas?) comes ?Frankenweenie,? a heartwarming tale about a boy and his dog. After unexpectedly losing his beloved dog Sparky, young Victor harnesses the power of science to bring his best friend back to life?with just a few minor adjustments. He tries to hide his home-sewn creation, but when Sparky gets out, Victor?s fellow students, teachers and the entire town all learn that getting a new ?leash on life? can be monstrous.

A stop-motion animated film, ?Frankenweenie? was filmed in black and white and rendered in 3D, which elevates the classic style to a whole new experience.

Look at the sweet little gift bag I received from Disney:

I am so excited to try the Frankenweenie dog collar on Eli.? I hope it is big enough!

Do you have any questions for Robert Capron, Atticus Shaffer and Charlie Tahan?? If so, please let me know.? I would love to ask them!

Stay tuned for more of my adventures from Hollywood!

How to Save the Newspaper Industry Part 1: Change Advertising ...

This is part 1 of a 3 part series about how to save the newspaper industry.

I met Joe Boydston?at Wordcamp in Salt Lake City. He is an IT director for a small group of newspapers in California, and is speaking at several Wordcamps to share his vision of the future of the newspaper industry. In his presentations he shows the innovative ways their newspapers using WordPress, social media, and advertising.

Joe led the newspapers he works for in adopting WordPress as a single CMS (content management system) to publish both the digital and print versions of the newspaper. ?The model is working. Ad rates are up 5,000%, and their audience is growing. All of this with no cuts to the newsroom. This at a time when many daily newspapers are hurting. They are either closing or laying off staff. (See also:?Newspaper Death Watch).

Newspapers make most of their money through advertisements, not selling subscriptions. Unfortunately advertising is way down. Some blame the internet for killing newspapers, but it?s perhaps more how newspapers treat online and print reads and ad rates. According to Joe, using a pay for performance model is to blame.

Newspapers use traditional banner ads across the top and sidebars of their websites. When?advertisers pay for print ads, they pay a set fee per day or by column inch (this site lists newspaper ad rates by state).?You can see the difference in pricing compared to banner ads ? just look at this ad rate sheet from Tampa Bay Times.?If you advertise online, you often pay based on the number of clicks. You pay much less for online ads.

For example: a print ad in the newspaper might cost $700 a day, the online version might bring in $7 a day. With readership shifting online, this represents a huge loss.

Rapidly declining advertising revenues continue to be the industry?s core problem. The losses in 2011 were slightly worse than those of 2010 ? 7.3% compared to 6.3%. Ad revenues are now less than half what they were in 2006.

-?State of the News Media 2012

Another issue is ad placement. Online, the ads are usually separate from the content, which diminishes its value.?Instead the ads can appear with the content, and look just like they do in print. The ads are only different from print in that they are clickable. They can be click to call, click to go to a web site, or click to enlarge (and possibly print) an ad, such as a coupon.

The ads are also shown no matter where the content is accessed.

Advertisements that appear in the printed newspaper will ?follow? each article on that page throughout the day. No matter how readers choose to receive their news, information and advertisements, the ad experience will remain consistent.

So looking at this, one way to increase advertising revenue is to create consistent content in print and online, including ads. Stop using banner ads which are based on CPM (cost per 100k impressions) and move to a different pricing model that takes total readership into account.

In Part 2 of this series I look at how newspapers can value online subscribers and how the papers use social media to extend their reach.

Apple's iPhone 5 is great, but maps, iOS 6? Frustrating for some.

Apple's new maps application, intended to rival Google Maps, is buggy, disappointing, and sometimes just plain wrong. New iOS is worth downloading but older Apple products can't access all the features.

By Troy Wolverton,?San Jose Mercury News (MCT) / September 20, 2012

Customers on Wednesday wait in line outside the Apple store on 5th Avenue, for Friday's iPhone 5 models to go on sale, in New York. The new smartphone is getting rave reviews but the maps application is buggy and the new iOS 6 features don't always work on older Apple devices.

Eduardo Munoz/Reuters

The?iPhone?5 isn?t the only product Apple is updating this week. On Wednesday it released a new version of iOS, the software that underlies its handheld devices.

' + google_ads[0].line2 + '
' + google_ads[0].line3 + '

'; } else if (google_ads.length > 1) { ad_unit += ''; } } document.getElementById("ad_unit").innerHTML += ad_unit; google_adnum += google_ads.length; return; } var google_adnum = 0; google_ad_client = "pub-6743622525202572"; google_ad_output = 'js'; google_max_num_ads = '1'; google_feedback = "on"; google_ad_type = "text"; google_adtest = "on"; google_image_size = '230x105'; google_skip = '0'; // -->

On the whole, iOS 6, as Apple has dubbed the update, is worth downloading. It?s faster and offers some compelling new features. But be prepared to be frustrated. Some of the new features are incomplete and one ? the overhauled?Maps?application ? is buggy and disappointing.

Older iOS devices won?t be able to use some of the new features in iOS 6. And two devices that could run iOS 5 can?t run iOS 6 at all: the original iPad and the third-generation iPod Touch.

I tried it out on my wife?s iPad 2, which came out a year after the original iPad and was eligible for the iOS 6 update. But despite being just a year-and-a-half old, the iPad 2 gets only a portion of the new features available in the operating system. Its version of iOS 6 doesn?t allow users to make Facetime calls over the wireless companies? data networks, while the new iPad?s version does. Nor does it include Siri, Apple?s compelling voice command feature, which just got some cool new tricks, including the ability to launch apps and to find sports scores.

It also lacks features that Apple decided were appropriate for the?iPhone?or the iPod Touch but not for any iPad. Among those are Passport, Apple?s new application that organizes digital loyalty cards and event tickets, and the camera app?s new ability to take panoramic photographs.

Those shortcomings aside, there still are plenty of new features in iOS 6 for older devices.

Apple has ditched the?Maps?application designed by Google, its former close partner turned archrival. In its place, Apple has a?Maps?application that it designed itself, which includes two neat new features. One is turn-by-turn navigation, a feature that Android has included for years but one that Google never built into its?Mapsapp for iOS. The other is something Apple calls ?Flyover,? which gives users a three dimensional overhead or birds-eye view of a city or location. The feature allows you to zoom in, around and over buildings in, say, downtown San Francisco, allowing you a sense of what the city actually looks like.

But those new features are matched with some serious drawbacks. Unlike the old version, the new?Maps?app doesn?t include transit directions. Instead, it points users to transit routing applications that they can download from Apple?s App Store. Unfortunately, there are no transit apps right now that are compatible with the newMaps?app.

The new app also lacks anything comparable to Google?s Street View, the street-level photographs of particular buildings and locations. Some people find Street View creepy, but I?ve found it to be helpful in identifying whether I?ve arrived at my intended destination.

Worse, the data in the?Maps?application is spotty and sometimes completely wrong. The app said that the Hay Market restaurant in San Jose?s Willow Glen area is actually located in Palo Alto, Calif. It also placed Yuki Sushi, another popular Willow Glen eatery, in Palo Alto, except when I asked it to look in San Jose. Then it found the one in Santa Clara, Calif., instead.

Other new features are less disappointing but similarly incomplete. For example, Apple has added the ability to link iOS devices to Facebook, allowing users to easily update their status from the notifications area, post photos directly from the gallery application and share Web links from the Safari browser. But the feature doesn?t allow users to post videos to Facebook from the gallery. Nor has Apple opened up the sharing feature to allow users to add services of their choice. So you can?t update your status on LinkedIn from the notifications page or post photos to Flickr from the photo application.

Likewise, Apple has added a neat feature to the Mail application that allows users to insert photographs or videos into a mail message as they are composing it. But users can only insert one photo at a time, and they can?t use the feature to attach other kinds of files, like a PDF or a Word document.

One of the grating things about iOS 5 was that it bogged down my wife?s iPad 2. Switching apps, moving between home pages, playing songs in iTunes all were inordinately slow or herky-jerky. At times the device seemed nonresponsive. By contrast, iOS 6 appears to be much smoother, faster and responsive.

Users can share their photos with friends and family members via Apple?s servers. Owners of recent iOS devices or Mac computers can see the shared photos in their gadget?s gallery apps. Users of other devices can see the shared photos in a special Web page. It?s a great feature, because unlike posting pictures on Facebook or other social networking sites, photo sharing allows users to easily share photos with only those people they really want to see them.

Another great thing about iOS 6 is that Apple has updated its iTunes and App Store applications and made them quicker. And they allow users to do multitask in ways they couldn?t before.

So users can continue to listen to a preview of a song in iTunes even after they have moved on to the page of another song or album. And the App Store no longer kicks users out once they start to download an application. Instead, they can shop for other apps while the download is in progress. That?s a feature that Android?s had for a long time, and it?s nice to see it finally arriving on iOS.

???

APPLE IOS 6:

?Troy?s rating: 6.5 (out of 10)

?Likes: Faster and smoother operation on older devices; users can easily share photos with friends via Apple?s servers; built-in Facebook integration; updated iTunes and App Store; turn-by-turn navigations finally added toMaps?app

?Dislikes: Unavailable for some older devices including the original iPad;?Maps?application doesn?t include transit directions or Street View and location data is faulty; some features not available for the iPad, including new Passport app and the ability to take panoramic photographs; other features, including Siri, not available for older devices

Private sector corruption rising amid downturn

MANILA, Philippines (AP) ? Private sector corruption appears to be on the rise in the Pacific Rim amid the global economic downturn, with countries in the region holding the worst reputation for bribery abroad, a U.N. expert said Thursday.

Samuel De Jaegere of the U.N. Development Program told an anti-corruption forum of the 21-member Asia Pacific Economic Cooperation group that companies in Indonesia, Mexico, China and Russia are the most likely to pay bribes when doing business overseas. He cited the 2011 Bribe Payer's Index.

He said a recent survey by Ernst & Young shows respondents indicating a 26 percent rise in private sector corruption in China and a 52 percent increase in Indonesia.

Between 75 and 93 percent of corruption cases being prosecuted before courts in Hong Kong and Singapore also involve private sector employees, De Jaegere added.

He said APEC members China, Russia, Mexico and Malaysia are among the top five countries with the highest cumulative illicit financial outflows from 2000 to 2008, according to the Global Financial Integrity Report. China tops the list with $2.18 trillion.

"The amount of ... capital flows generated from illegal activity, including corruption is staggering in the APEC region," De Jaegere said.

More than $1 trillion a year in illicit money leaves the developing world each year, and almost 90 percent of total flow in Asia is transferred through trade mispricing or the downplaying of profit to minimize overall tax, he said. Profit is then stashed in tax havens.

De Jaegere said the Financial Secrecy Index published last year for the first time ranked four APEC members in the top 10 as attracting illicit money flows from developing countries: Hong Kong, the U.S., Singapore and Japan.

Jesse Ang of the International Finance Corp. said a World Bank survey estimates that small and medium enterprises spend up to 33 percent and in some cases 49 percent of revenues on bribes.

Around 90 percent of companies worldwide are SMEs and they pay around $100 billion in bribes each year, said Shervin Majlessi of the U.N. Office on Drugs and Crime.

Majlessi said anti-corruption efforts should focus on SMES, which are more vulnerable than bigger companies to corruption because of their size and limited resources and bargaining power.

(AP Photo/Sierra Vista Herald, Beatrice Richardson)

(AP) ? House Republicans investigating a bungled gun-trafficking probe in Arizona see vindication in a long-awaited watchdog report that criticizes one of their favorite targets: Attorney General Eric Holder's Justice Department. But Justice's inspector general absolved Holder himself of blame.

The department's internal watchdog, Michael Horowitz, will be the only witness Thursday before the House Oversight and Government Reform Committee, a day after he faulted the department for misguided strategies, errors in judgment and management failures in an operation that disregarded public safety and allowed hundreds of guns to reach Mexican drug gangs.

"The inspector general's report confirms findings by Congress' investigation of a near total disregard for public safety in Operation Fast and Furious," said Rep. Darrell Issa, R-Calif., the committee's chairman.

However, committee Republicans will have to tread carefully. The IG's report knocks down some of the many accusations Republicans have made about the Obama administration during their year-and-a-half-long investigation of the operation by the Justice Department's Bureau of Alcohol, Tobacco, Firearms and Explosives. In places, the report reads like a rebuttal of House Republicans' past statements.

"We found no evidence" that staff at the department or at ATF informed the attorney general about Operation Fast and Furious before 2011, the report says.

Former Acting Deputy Attorney General Gary Grindler received a briefing on Operation Fast and Furious in 2010.

"We found, however, that the briefing failed to alert Grindler to problems in the investigation," the report says.

"We found no evidence to suggest" that Assistant Attorney General Lanny Breuer, head of the Justice Department's criminal division, was aware that the ATF and the U.S. Attorney's Office in Arizona had adopted a strategy of not interdicting firearms, the report adds.

Still, the inspector general's report was a form of validation for the Republican-led investigation, saying lower-level officials should have briefed Holder about the investigation much earlier.

The inspector general referred 14 people for possible department disciplinary action in Operation Fast and Furious and a separate, earlier probe known as Wide Receiver, undertaken during the George W. Bush administration ? Grindler, Breuer and two other people from the Justice Department, four from ATF headquarters, four at ATF in Phoenix and two from the U.S. Attorney's Office in Phoenix.

A former head of the ATF, Kenneth Melson, and a deputy assistant attorney general in Justice's criminal division in Washington, Jason Weinstein, left the department upon the report's release Wednesday ? the first by retirement, the second by resignation.

Operation Fast and Furious involved "gun-walking," an experimental tactic barred under longstanding department policy. ATF agents in Arizona allowed suspected straw purchasers, in these cases believed to be working for Mexican drug gangs, to leave Phoenix-area gun stores with weapons in order to track them and bring charges against gun-smuggling kingpins who long had eluded prosecution, but they lost track of most of the guns.

Two of the 2,000 weapons thought to have been acquired by illicit buyers in the Fast and Furious investigation were recovered at the scene of a shootout that claimed the life of U.S. border agent Brian Terry. About 1,400 of the total have yet to be recovered.

The experimental operations were a response to widespread criticisms of the agency's anti-smuggling efforts. Because of thin ATF staffing and weak penalties, the traditional strategy of arresting suspected straw buyers as soon as possible had failed to stop the flow of tens of thousands of guns to Mexico ? more than 68,000 in the past five years.

Fast and Furious has produced charges against 20 gun traffickers, 14 of whom have pleaded guilty so far.

Horowitz indicated he will continue his investigation of matters related to Fast and Furious, Issa noted, including a look at possible retaliation against whistle-blowers and an effort to have the Justice Department unseal wiretap applications that were approved by senior officials.

A cover memo reviewed by Weinstein for one of the wiretap applications in Fast and Furious "clearly suggests" ATF agents had allowed a known illicit gun purchaser to continue his illegal activities for a gun-trafficking ring selling weapons to a Mexican drug cartel, the inspector general's report found.

In response to the criticism, Weinstein's lawyer said that before reviewing any Fast and Furious wiretaps, Weinstein had been assured by ATF Deputy Assistant Director William McMahon that guns were being aggressively interdicted.

During the House committee's investigation, President Barack Obama ordered Holder to withhold from the House committee, under executive privilege, some documents describing how the Justice Department responded to the panel. The Republican-controlled House voted to hold Holder in contempt, and Issa's committee has filed a civil lawsuit to make the administration turn over the documents. Horowitz said he was not denied access to any of the documents.

Spotlight Nonprofit: Raising awareness among young men that ...

LatinaLista ? Prostate cancer has long been considered an ?old man?s disease.? Not anymore if Gabe Canales has his way.

logo Spotlight Nonprofit: Raising awareness among young men that prostate cancer isnt just an old mans disease

Only 35-years-old when he received news that he had the ??blue? men?s side of the ?pink? campaign for women?s breast cancer,? Houston-native Canales didn?t know anything about the organ or that kind of cancer ? so he learned. He discovered that prostate cancer is more common than breast cancer, usually strikes men over the age of 50 and is the most common cancer in men and the second leading cause of cancer-related death in men.

Shaped like a doughnut and weighing about an ounce, the prostate gland, Canales learned, is just below the bladder, behind the pubic bone and just in front of the rectum. It helps control the flow of urine and is one of the organs involved in the production of semen.

When the prostate becomes cancerous it means the cells in the prostate are abnormal and growing at an uncontrollable rate, forming tumors. As a result, there are a list of symptoms that signal the disease, if a person knew what to look for.

Canales hadn?t known what to look for. It was by accident that he was discovered to have the disease. Wanting to find others who shared the same diagnosis, Canales, founder of his own marketing and PR company, knew what he had to do ? create a Facebook page. ?Journey with Prostate Cancer? was created and before he knew it over 7,000 people had signed on for the education and mutual support they found there.

Because of the success of that Facebook page, Canales was inspired to launch the Blue Cure Foundation.

The organization?s mission is to save lives. It strives towards this goal by promoting education about the cancer, especially among college-age men, encouraging preventative measures that include ?anti-cancer? dietary and lifestyle habits, advocate for increased research funding and serves as a virtual forum for support and information-sharing among survivors.

In 2012, it is estimated that there will be 241,740 new cases and over 28,000 deaths caused by the disease because those men and their families didn?t know enough to recognize the symptoms.

I?m devoting the rest of my life to raising awareness and saving lives? Our goal is to raise awareness of prostate cancer, encourage annual screenings, promote healthier lifestyles for preventative measures and reach a younger generation ? Gabe Canales.

(AP) ? Clint Eastwood's oddball GOP convention monologue didn't sit well, but Democrats proved they know how to exploit their unabashed love affair with Hollywood.

The beautiful triumvirate of Scarlett Johansson, Kerry Washington and Eva Longoria thrilled the Charlotte, N.C., convention crowd Thursday with their looks and words. Mary J. Blige and James Taylor provided the tunes. And "Mad Men" star Jon Hamm looked happy just to be part of the crowd.

There wasn't an empty seat in the house as delegates cheered the display of star power.

It's routine for Republicans to mock liberal Hollywood and its money as pushovers for Democrats, and the party as a sucker for the entertainment industry's glamor. Sen. John McCain tried to tag Obama himself as a lightweight star during their 2008 contest for the White House.

This campaign has produced an ad from a pro-GOP super PAC that proclaims, "Four years ago, America elected the biggest celebrity in the world," and shows Obama dancing with Ellen DeGeneres and singing an Al Green song.

The Democratic response on the convention's final night: If you've got 'em, flaunt 'em.

Johansson took the stage to share her childhood delight at stepping inside a polling booth with her mother? "a registered Democrat" ? and helping her mom to vote, whether that was legal or not.

"This last election, I finally got to punch those buttons for real. For me! I was so excited, I wore my 'I voted' pin the whole day. It was my finest accessory," said the 27-year-old actress.

Washington gave a sterner speech.

"Look, I get it, right: Whether it's school, work, family, we've all got a lot on our minds," she told the crowd. "We've all heard people say, 'I'm just too busy to think about politics.' But here's the thing: You may not be thinking about politics, but politics is thinking about you."

Longoria, a co-chair for Obama's re-election campaign, drew a contrast between the 99 percent and the 1 percent, using herself as a before-and-after example.

She warned that Republican presidential nominee Mitt Romney would raise taxes on middle-class families to "cut his own, and mine."

"That's not who we are as a nation, and here's why: The Eva Longoria who worked at Wendy's flipping burgers-she needed a tax break. But the Eva Longoria who works on movie sets does not," said the former "Desperate Housewives" star.

An impish Taylor brought a prop, a chair to invoke the image of Eastwood's rambling lecture last week to an empty chair that, for Eastwood, contained an invisible Obama.

"It's an empty chair, it makes you nervous," the musician said as he took the stage. "Don't worry ? I'm going to sit on it. I'm not going to talk to it."

Taylor did as promised, then delivered "Carolina in My Mind" and other upbeat songs along with his campaign endorsement.

"I'm an old white guy, and I love Barack Obama," he said.

Democrats, who revel in being the party of diversity, made sure that was true of the music as well. Blige drew delegate cheers when she urged them to "make it a family affair and get it crunk for President Obama for four more years," then rocked the room with her cover of U2's "One" and her hit, "Dance 4 Me."

Neb. school heads accused of sex abuse cover-up

OMAHA, Neb. (AP) ? Authorities have accused a Nebraska school superintendent, principal and coach of failing to report the alleged sexual assault of a young high school wrestler by several teammates last summer.

The Nebraska State Patrol on Tuesday cited the three Maxwell Public Schools officials ? Superintendent Danny Twarling, Principal Aubrey Boucher, and head wrestling coach Ryan Jones ? for suspicion of failure to report child abuse or neglect, which is a misdemeanor.

Lincoln County Attorney Rebecca Harling didn't immediately return a Friday phone message enquiring whether her office was considering charging the officials or the alleged assailants. Patrol Lt. Lynn Williams said that as of Friday, no legal action had been taken against any of the Maxwell High School team members.

Patrol Investigator Carlos Trevino, in an affidavit, said several members of the wrestling team were present during the alleged attack at a wrestling camp last summer. According to the alleged victim and two boys who said they witnessed but didn't take part in the attack, two team members held down the younger boy while another sodomized him with a soda bottle. On another occasion, at least one team member allegedly groped the victim on a school bus, Trevino said.

Last month, state troopers exercised a search warrant on Maxwell High School and seized personnel files, correspondence and other records. In the warrant, investigators said they expected to find evidence of reported sexual abuse or assaults, intimidation, inappropriate touching and language, and hazing at the school.

Twarling, reached Friday by phone, read a statement confirming that district employees were served with citations on Tuesday.

"The school district maintains that it adheres to both the state law and district policy and reports all incidents of abuse and neglect to the proper authorities when there is reasonable cause to make such a report as provided under Nebraska law," Twarling said.

He declined to comment further or answer questions. Neither Boucher nor Jones immediately responded to phone messages and emails Friday seeking comment.

Authorities began investigating following a call to a child abuse hotline, said Williams, who declined to say who placed the call or what was discussed.

According to the affidavit, a woman from the district brought the alleged camp assault to the attention of the principal, Boucher, writing in a letter that her family members wouldn't be enrolled in the district because she had seen video of the attack.

Williams said investigators haven't seen such video, and he wouldn't say whether investigators believe it exists. The affidavit doesn't explain who might have recorded the assault.

The woman told investigators that Boucher contacted her after receiving her letter and told her "he would get to the bottom of it." She said she tried following up with Boucher over the next two days, but that he was never available to take her calls and he never returned her messages.

The woman said she asked the boy if he had told his coach about the assault, and that the boy "said he was told, 'What happens in wrestling, stays in wrestling.'" It's unclear from the affidavit whether the boy said he did tell the coach and whether it was the coach who allegedly responded that way.

Two students told investigators that they told Boucher that they witnessed the abuse, Trevino said in the affidavit. The alleged victim told investigators that Boucher called him a liar and "a rumor spreader."

Both Boucher and Twarling told investigators that they knew of the sexual assault accusations and that they had determined that the accusations were unfounded. Nebraska teachers, administrators, medical professionals and others in positions of authority are required by law to report cases of suspected child abuse or neglect to law enforcement.

A look at cable, satellite TV earnings reports

Cable and satellite TV companies have been releasing their earnings reports for the latest quarter.

The second quarter is usually a weak one for pay-TV services because students cancel their subscriptions ahead of the summer holidays, and some "snowbirds" cancel their winter home subscriptions before heading to their summer homes.

Here is a summary of earnings reports for selected companies and what they reveal about the industry's prospects:

? July 19: Verizon Communications Inc. says it added 120,000 FiOS video customers to end with 4.5 million in June.

Dish Network Corp. says it lost a net 10,000 subscribers, which was smaller than analysts predicted in a typically week quarter for pay TV operators. It ended the quarter with 14.1 million subscribers in the U.S.

? July 24: AT&T Inc. says it added 155,000 U-verse TV subscribers to end with 4.1 million.

? Aug. 1: Comcast Corp. says it lost 176,000 video subscribers, though the rate of decline has slowed. It ended the quarter with 22.1 million to remain the nation's largest.

? Aug. 2: DirecTV Inc. says it lost 52,000 U.S. subscribers, the first quarter it has lost subscribers. DirecTV ended the quarter with 19.9 million U.S. subscribers, making it the second-largest provider of pay-TV signals in the country, after Comcast. DirecTV's Sky Brasil and PanAmericana added 645,000 subscribers. That was up from 472,000 a year ago and the best result ever for the company.

Time Warner Cable Inc., the second-largest cable company, says it lost 169,000 subscribers in the second quarter, a record for the company. It ends the quarter with 12.3 million.

? Aug. 7: Charter Communications Inc., the country's fourth-largest cable-TV provider, lost 72,000 TV customers in the quarter to end with 4.3 million.

Cablevision Systems Corp. has stemmed the loss of TV subscribers for the second quarter in a row, at the cost of holding its prices steady. It held the number of TV subscribers steady at 3.3 million.

? Aug. 8: Dish Network Corp. reiterated that it lost 10,000 subscribers, leaving it with 14.1 million and as the third-largest provider of pay-TV signals to U.S. homes.

Obama 'HOPE' poster artist set for NY sentencing

FILE - In this Nov. 12, 2011 file photo, artist Shepard Fairey arrives at the MOCA Annual Gala in Los Angeles. He faces up to six months in prison. (AP Photo/Dan Steinberg, File)

(AP) ? The artist who created the "HOPE" poster that came to symbolize Barack Obama's 2008 presidential campaign will be sentenced Friday, with prosecutors seeking a prison sentence for his criminal contempt conviction and his lawyers arguing that he should face no prison time for the misdemeanor charge.

The government said in a presentence memorandum that Shepard Fairey, 42, should serve some time for destroying documents and fabricating others in a civil lawsuit he brought against The Associated Press in 2009. No prison term, it said, would send a "terrible message" to others who might engage in similar conduct.

Prosecutors told U.S. Magistrate Judge Frank Maas in Manhattan that Fairey had "both an ideological and financial motive" to alter evidence in his favor after basing his poster on one of the AP's photographs. They said he did so over several weeks, engaging in behavior that "cannot be dismissed as remotely impulsive or the product of a moment of bad judgment."

"This was not a mere failure to preserve documents," the government wrote. "This was the intentional destruction of evidence and the intentional manufacture of false evidence. The defendant knew exactly what he was doing when he created the fake documents and sought to destroy the deleted documents."

They noted that revenues at three companies he controlled doubled from roughly $3 million in 2007 to $6 million in 2009 while he was honored repeatedly, including being chosen to design the official poster of Obama's 2009 inauguration and commissioned to create the cover image of Obama for Time magazine's 2008 Person of the Year, which was displayed in an exhibition at the National Portrait Gallery.

Defense attorneys argued that a prison term was not warranted, noting that the misdemeanor charge carries a potential of only six months in prison.

They said Fairey is contrite and noted that he settled his civil case with the AP on unfavorable terms that included sanctions. The government outlined in its court papers that the deal required Fairey to pay the AP $1.6 million, with an insurance company contributing about $450,000 of that amount.

In their sentencing memorandum, defense lawyers described Fairey as a devoted husband and father of two young daughters who runs companies that employ almost 30 people and who serves as the creative force behind a clothing line that employs another 80 people.

They called his crime the "worst mistake of his life" and said he altered evidence "not to better his chances of winning the lawsuit or to enrich himself, but out of fear of embarrassment."

The lawyers wrote that Fairey, who has diabetes, has already suffered "significant damage to his reputation," adding that an Internet search of his name "now produces results not just about his artistic and civic accomplishments, but also many websites degrading him for his misconduct."

Teen Parties in Your Home: What You Need to Know | FamilyBlawg

Entertaining your teen?s friends in your home can be a great way to keep a close eye on your child. You get to be the fun parent that allows your teen a place to party with their friends. Now, while it sounds like an ideal option to keep your kid home on the weekends, there are some serious liabilities that you face when your home is opened up to partying teens. As a responsible parent, entertaining teens can be easy, fun, and safe, but is important to remember that anytime you have people on your property there is potential liability. Teens create a special liability because the law expects adults to maintain a reasonably safe environment with some level of supervision.

Drunk-Driving Accomplice

One of the things people forget about personal liability is that your responsibility might not end when a partygoer leaves. If a teen has been drinking at your home, especially if you provided the alcohol, whether or not it was meant for their consumption, and they injure someone while driving home, you could be held liable for the damages to both parties. The law would consider you a ?social host,? and therefore, you could be considered liable. You can avoid this issue by ensuring that you have no alcohol in your home if you are going to entertain teenagers. There have been cases where a parent, trying to be ?cool,? provides the drinks for a teen party and ends up facing financial liability and prison time for being a party to a drunk-driving accident.

Let?s Get Ready to Rumble

Some teen parties end with people fighting. Teens are notorious for their drama and jealousy. If a fight happens in your home, and someone ends up injured, the law might hold you financially accountable. According to www.personalinjurylawyersny.net, if a court finds that you should have provided more supervision, you could have a personal injury judgment on your hands. This can cause your insurance rates to increases substantially. It is best that you be there so you can quell any confrontations before they get dangerous.

Accidental Injuries

Parties are meant to be a good time. Swimming pools and playground equipment can enhance a party, but they also enhance your personal liability. Now, the law does not expect any party host to be 100% responsible for the behavior of their party guests. However, when teenagers are involved, the law does expect there to be an appropriate level of supervision.

What is an appropriate level of supervision? Well, that all depends. If the teens are older, such as 18 or 19, the level of supervision can be minimal. These are adults, and the law expects them to use ordinary care in their lives. If they are 13-17 years old, however, it is best to use caution and provide full supervision while they are in your home.

Personal liability should not stop you from having parties if that is what you enjoy. However, some simple precautions can save you a lot of financial and legal trouble. Be aware of who is there and keep the party size to a minimum. If there are troublemakers, get them off your property. You can entertain, have fun, and protect yourself all at the same time.

Anthony Joseph is a contributing author for www.personalinjurylawyersny.net, a site which provides information to injured victims who have been in accidents.? You can have access to personal injury attorneys and legal professionals in the New York area, and receive information needed to pursue compensation for your injuries.

Managed Computing Business - The Best Prepaid Mobile Phone Vs ...

2012 ? computers at aldi. ? Managed Computing 2013 omap 4430 memory bandwidth, best desktop computer 2012 uk.

pFor several years, options were really slim and far between when we talked about nbsp;prepaid wireless phones as well as services. But these days, with the improvement and still ongoing progress in a title=wireless-cell-phone href=http://best-prepaid-phone.org/best-prepaid-phone/wireless-cell-phone/ target=_blankmobile phones/a, alternatives have become varied and plenty. But, even until now the old debate, on whether prepaid wireless phone is better than a cellular phone service plan, still stands. A prepaid wireless phone permits you to pay only just what you use thereby, providing you a lot of leeway and freedom when it comes to usage. Whereas the latter stifles you to a contract for about 2 years with a monthly bill. I guess the choice would be varied for nbsp;different people. Such a choice would most likely depend on the necessity that each person has./p
p Precisely what is popular amongst the a title=pay-as-you-go-mobile-phones href=http://cell-pay-as-you-go.org/cell-phone-plans-2/pay-as-you-go-mobile-phones/ target=_blankbest prepaid phones/a is actually that you have manage over your usage. When your phone call or SMS credits has no more, then thats about it. You could opt either to buy new credits or not. With respect to a lot of people who decide on this option, this provided them greater control over their usage. This also allowed them to make the most of their other phone features such as SMS texting which are far less expensive than calling. Dispatching SMS communication these days is actually like having someone talking over the phone. Correspondence are actually faster and better, as a result of wider reach of connectivity. These features may have been the characterizing reasons why a lot of people still opt for the best prepaid phone packages.br /br / Likewise, receiving monthly bills for phone call and SMS services may well be more worthwhile for a few. People who considered that as the better option are really usually those who make constant calls that are necessary for business organisation. There are service companies which allow unlimited call as well as text for the same level of monthly bill if phone calls were made between the same service carrier. For folks in the business sector, particularly those in Sales, this is really the better option. Supervisors will be able to track and communicate with their sales representatives much more frequently without having to mind ballooning bills. Sales realtors would certainly be able to correspond more useful with their clients, likewise. What is best about this set up is that you probably would not have to worry about loading fresh credits in your cellphone as compared to prepaid wireless phones. So long as you pay your monthly charges on time, connectivity along with correspondence is unlimited and unregulated./p
pIf you are still making a decision what kind of option to acquire consider the following features mentioned. You must also ask yourself what type of a title=selecting-the-iphone-application-to-suit-your-needs href=http://prepaid-wireless-phones.org/compare-prepaid-wireless-phones/selecting-the-iphone-application-to-suit-your-needs/ target=_blankfunctions/anbsp;you demand for from your wireless phone. Community college health insurance plans are surprisingly tricky

Many students are lucky enough to benefit from the fact that their parents have jobs that allow them to provide health insurance coverage for the whole family. Often, these policies extend to the age of 25 so that kids who are unable to work full-time jobs (and thereby obtain benefits) due to the demands of schooling don?t have to go uninsured during their time at community college (and beyond). Of course, not all students have this luxury, and while the fees you pay for health services will give you access to the health center on campus, the options for treatment are almost certainly limited.

Often you can receive testing, immunizations, and counseling, and some campuses may also offer STD screenings and treatment as well as reproductive care of some nature (access to protection and perhaps even family planning services). But in general they will refer most issues to area doctors or hospitals, especially in the case of serious illness or injury. And if you?re uninsured this could end up costing you quite a bit. But is it worth getting health insurance through your community college or are you better off seeking coverage from an outside source? Here are a few things to consider.

First, you should know that some colleges require students to have health insurance in order to attend. According to a 2008 report by the Government Accountability Office (GAO), nearly a third of schools won?t let you in without it. So you might not have a choice about purchasing healthcare coverage. That said, you do have a lot of other choices, such as where you get insured, the type of coverage you select, and how much you pay. But most students aren?t as concerned with where their policies come from as how much is going to come out of their pockets.

The thing is, there are tradeoffs with each plan. For example, campus plans for coverage vary widely from school to school. Some could cost less than a hundred dollars a year while others could go for upwards of $2,500. Then there are deductibles to consider (or the amount you?ll pay out of pocket before your coverage kicks in) and these generally range from about $500-1,000 per year. And there are limitations on where you may seek service as well as maximum benefits (which tend to top out in the $30,000-$50,000 range). Plus, only about half of schools offer their own insurance plans, so you might not even have access to such coverage.

As for individual insurance plans, there are other pros and cons to weigh. In general, you can expect to pay higher premiums (your up-front cost) than you would through your university. And for the student that is fit and healthy this may not sound like a very good idea. However, the trade-off could be lower deductibles, little cost for in-office visits, access to a wider range of healthcare facilities and services (including specialists, pharmaceuticals, and out-of-town coverage for care), and extended coverage for major illness or injury. For example, a student at high risk for health-related issues like diabetes, cancer, and so on would almost certainly want to err on the side of caution and opt for individual insurance since treatments for such a diagnosis could quickly burn through the limited benefits offered by many college plans.

Of course, you don?t have to master health administration jargon to know that the benefits and drawbacks depend largely on the plan. So it pays to do your homework here and delve into all of your options before making a final decision. The student on a budget may not have a lot of wiggle room when it comes to ?extras? like insurance (which is probably why an estimated 20% go without). But if you?re interested in obtaining coverage for colds, flus, and the unexpected broken leg or diagnosis of a chronic disease, then you should definitely look into insurance plans both on and off campus to choose the one that?s right for you.

Payvia Wins Exclusive Contract To Power SMS Donations In Obama For America Campaign

obama-smsPayvia, which just launched its new mobile payment platform for carrier billing this July, has been selected as the exclusive vendor to power the campaign contributions for Obama for America (OFA). This will allow supporters to send in donations to the campaign via text message, and those charges will later appear on the user's monthly cell phone bill. The company says it first presented its service to the Federal Election Commission earlier this spring (before its public debut), and then was approved unanimously by FEC members votes. This is the first time politicians have been able to receive donations this way - something that was made possible by the FEC's ruling in June that authorized this grassroots method for political fundraising.

Home-Improvement Basics For Anyone To Get The Home Of Your ...

Focus on interior lighting for your next home improvement project. If you change out your old light bulbs with Compact Fluorescent Lights, you will save energy and money. These bulbs also last longer than traditional lighting choices. This is a very simple project that will have remarkable results on the amount of money you save in energy bills.

Homeowners undertaking major renovation work on high-value homes should engage an architect. While their services are expensive, architects make back their cost on large, complex projects. They help homeowners manage complex jobs involving multiple contractors and sub-contractors and have the aesthetic sensibilities which can preserve and increase the market value of an expensive home.

Take advantage of a small bathroom space by getting great deals on remodel materials. For example, your limited countertop and flooring needs translate to a higher likelihood of you finding both countertop and flooring remnants that will work at your local DIY, bathroom or carpet store. These remnants are still brand new but come at a steep discount thanks to their fixed dimensions.

For slow-draining toilets caused by tree roots, use a foaming tree root remover in your toilet every six months. While regular granules of copper sulfate do work, only the tree roots that come into contact with the granules are killed. A foaming product fills the entire pipe with solution, ensuring that all of the roots die and break off, leaving your pipes free and clear.

A great home improvement tip to use for selling your home or even improving how it looks is to add exterior lighting. Whether you?re lighting up your driveway or simply your front and/or back porch, some exterior lighting on and around your home makes a huge difference and enables your home to stand out.

Keep your partially used can of drywall compound from drying out between uses! All you have to do scrape and wipe the insides of the can down to the surface of the remaining drywall mud. Next, pour just enough water onto the mud to cover its surface. Before you use it again just pour off the water and it will be as good as new!

A great way to add value to your home is to add a sun room to the back of your house. Any time you add square footage to your home, you are increasing its value. Additionally, a sun room looks great, giving your home more appeal to a buyer.

You should do a simple internet search if you are looking for general contractors in your area. Many contractors are now posting ads online to help boost their business. You can find a contractor that fits your needs and even reads reviews from their previous clients. This is a quick and easy way to find a contractor to do your home improvement job.

If you are low on cash, but need to remodel your kitchen cabinetry, a great way to save money is by ditching cabinets altogether. Set up some nice shelving on the wall with canisters to store your items and use baskets to store larger groceries you may need. This creates a really neat shabby chic look that looks great in old colonial homes.

If you are planning on painting a room as part of a home improvement project, you can save money by accurately estimating the amount of paint you will need. One gallon of paint will cover about 350 square feet of wall space, unless you are painting drywall, which absorbs more paint. An accurate estimate can prevent you from overbuying paint, which once mixed in a specific color generally can?t be returned.

When buying material for any home improvement project it is important for you to take the time to shop around. You need to make sure that you are getting the best price that you possibly can and that something is not overpriced at the store. You can typically comparison shop online.

How to paint an indoor room quickly and easily. If possible, try to do all your painting in daylight hours, as artificial light can cause you to miss small areas. Tackle the ceiling first, painting around the edges in bands, and working your way into the center. The walls should be painted starting at the top, and working downwards in sections.
